Explanation of the trade: I have been affiliated with Agile Life for around a year now maybe more. Got interested in doing a HCIM so I asked Agile how much to get one made via him. Priced at the $320 above for what I was looking for.

How they scammed: 2 other Dead HCIM's both of which were remade no-fuss however all being made slowly. After 2nd one was made I requested a faster worker which Agile brushed off.

After about 2 months (original quoted time) I had asked why we weren't even halfway through the order and agile stated that the worker was very slow and they were trying to finish his que to get him gone so the worker already had a prior record of issues it seems. Agile stated that he would try to get him moving which I had stated give me someone who will get it done if the guy doesn't pick up the pace. So we agreed on giving the worker a few days to pick up the pace. 3 days later acc was banned for Real World Trading Gold farming.

After which I asked for a refund as I didn't think that the worker would re-complete the account in a reasonable amount of time judging by his prior track record. Which was countered with 60% refund which I refused as I had not received an account besides the 2 dead irons which were worthless to me (neither even made it to 99fm) Probably valued at $40 for both of them. Agile stated that the only reason he wouldn't fully refund was that the acc was banned not because it died.

Which isn't his fault. Agile is stating that I have agreed to his TOS which I have not. The only reason I have been in his server was due to our affiliation with Inferno capes not to order via him.
Honestly not trying to witch hunt Agile by any means I think he is an alright guy just no final agreement could be made that we are both satisfied with.

You made this comment in regards to Matt himself having an order made, you stated this shortly after the 1st account had died, I had made it clear to you that this worker wasn't interested in doing said task. To also prevent the constant change in IP's access the account to prevent any bans or locks we limit the account to one worker to try and prevent issues like this from happening.

You keep going on in terms of the service being slow however, yourself even stated that you had 0 stress in terms of how long this service takes. From what stated in those frames there that's roughly 2 months. Cause of the account deaths the accounts time frame kept getting reset.

You had placed a message asking for a new worker, in which I said I'd speak to him as yes this has been an issue before. In which a simple message has resolved the entire issue. As stated in the messages here: Screenshot - 43b3e7de1182621358b2f20633e9a5b0 - Gyazo we had agreed to a 1-week time frame for improvement before any new worker would be replaced on the order. The issue which is going on as well due to the worker being a Venezuelan is a result in power issues as I was even message yesterday by my worker manager stating they were working on some stuff and was affecting their power and internet requiring them to change their working patterns. (This can be provided on request.)

This is correct that I offered him 60% of his order payment back due to when we first started discussing this order the only thing he had requested was that if the account had died if we'd re-make it for him. As stated in the picture below we don't tend to do this, however. Due to our friendship and partnership I agreed out of kindness. I felt that refunding him a full amount on regards to a ban which wasn't our fault, his fault or the worker's fault isn't fair. This is also because since the 02/08/2020 and 21/08/2020 both my discord server and Mrpotato's made a post in regards to Jagex's new rules regarding account services or sharing.

In regards to him stating he never agreed to my terms of service is false. In order to view, message or even do anything within our discord server you have to type the command "!agree" within our server to gain access to it. @MrPotato24 has even stated that he did this but apparently he was "forced" to do so which comes odd as I never forced him to do so.

Furthermore, He then proceeds to state that he wouldn't have even created a ticket with us cause of our terms of services yet within the direct chat he asked me if he should create a ticket. : Screenshot - d927110b3f540a3242c9db287a8a12c3 - Gyazo

Another thing he disagree's to how our terms of service are stated yet they are 99% equal to his own within his discord server. (Can provide direct proof on request no issue.)

I disagreed to these terms of service as you can read he's now trying to basically dictate what should happen. With Jagex's stance on Account servicing and sharing and targetting a large number of "Hardcore ironman" accounts it would be near impossible to ensure no ban on the account.

I feel him saying if the work is slow would mean after a couple of days he could just turn around and say I'm not happy with the speed refund me.

To me a service provider and running his own server Potato should respect and understand those terms are appalling and unfair because they basically allow for someone to get what they want.

I'm not at the point I do not wish to create any account for @MrPotato24 I'd like if the Sythe staff feel that a reasonable refund is due for the work done I'll refund what is due. I do not wish for myself or my team to work on an account in which isn't going be used or played because as even stated here: Screenshot - cdf10b04f3dd45bce8c31235d4efb2c2 - Gyazo he's got no intention of playing Runescape and he didn't even want this rebuilt because was going to be used.

I've offered him a 60% refund on the basis the account was:

99 Firemaking
73 Agility
70 (close to 71 Runecrafting - done at Arceuus library).

What was remaining - Barrow gloves, 6 and a bit Runecrafting levels and stats for barrow gloves.

My only follow up would be that 70-71 RC is a tad over halfway to 77. Barrows gloves stats + Lunar Dip stats and Avas were all not done. Which was left out just for the sake of clarifying that.
The account would have still been used FYI even if rebuilt whether sold or played on that would be on me depending on how much time I had when the account was completed which is why I offered remake under the terms I gave as the worker hadn't proven that he would put any more than the minimum amount of time into the account which was my reasoning for asking for a refund. Granted we were giving him a week which was why I was willing to give it another shot as we have both stated above.

 

issue was your terms weren’t reasonable. Stating if the account gets banned - refund, if the worker isn’t to your standard - refund, if the account dies - refund. It more works into your favour of what you wanting instead of compromising.

no service provider would agree to that not even yourself because it just unreasonable. It leaves it open to exactly what the customer would want and I don’t see anyone agreeing to it.


I’m not clear on what quests were or weren’t completed on the account so I’m unable to comment regarding that, although could ask for the worker to provide the completed work folder.

please note you’ve also already obtained two accounts which had died which even yourself had stated you could sell for at most $40. Therefore you’re still gaining something out of this.

this is why I’ve gone with the valuation of 60% refund as barrow gloves themselves were roughly 50% of the order.

A ticket was never created. I said I could make one however I had not done so. This was all done via DM's Screenshot - 48b5cfa0f1d5d2a6a2b04a82ddf572fa - Gyazo SS of proof as you can see top left this was in my conversations. Thank you for your response though and interested to see the verdict on this regardless of the outcome.

 

This is correct, the order was done through direct message which has been stated to Pirate in chat. This was due ticket system being closed at the time sorting things within the server. This was stated to Potato in a message as well as he was prepared to create a ticket.

As you can see at the bottom of the messages he had accidentally opened a ticket, due to role settings he had but this was closed and finished indirect message. But can be shown that he had seen the message above in regards to Terms of Service.

 

So even if done VIA dms if the person is in your server they are falling under the Services rules. Just looking for clarity for my own discord in the future
