It is possible, but it's just very unlikely. It seems as if someone knew all of the account details and while you were gone, they tried keeping your account.

My account was perm banned in 06. I recovered it about 2 weeks ago and they accepted my appeal. Goodluck!

The longer you have to wait, the better.
Same as for when you are recovering an account back.

It depends on the ban reason, I'm not sure '09 would be a long enough wait but depending on the ban reason you might have a chance. Hopefully its not RwT or phishing other users, those are unlikely unbans.
